1. Acceptance
By downloading or using HeatCheckr, you agree to these Terms. If you don't agree, please don't use the app.
2. Description
HeatCheckr is a mobile app providing spoiler-free game excitement indicators — scores, labels, and links to official highlights — for NBA and other leagues. The app is available in a free tier (ad-supported) and an optional premium subscription called Heat Pass.
3. Free Tier & Advertising
The free tier is supported by non-personalized advertisements served by Google AdMob. Ad content is provided by third parties and we are not responsible for individual ad content. You may dismiss the ad banner by tapping the close button.
4. Heat Pass — Premium Subscription
Heat Pass is an optional paid subscription that unlocks additional features including full EuroLeague coverage, season history, ad-free experience, and multi-team favorites. The following terms apply:
- Billing: Heat Pass is available as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Prices are displayed in the app before purchase and may vary by country and currency.
- Auto-renewal: Monthly and annual subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method on file with Apple or Google will be charged upon renewal.
- Cancellation: You may cancel at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not process cancellations directly.
- Price changes: We reserve the right to change subscription prices. You will be notified of any price change in advance. Continued use after the effective date constitutes acceptance of the new price.
- Refunds: All purchases are processed by Apple or Google. Refund requests are subject to their respective refund policies. JDK Development does not issue refunds directly. To request a refund, contact Apple Support or Google Play Support.
- Lifetime purchase: The one-time lifetime purchase grants access to Heat Pass features for as long as the app exists and the features remain technically available. It does not guarantee any specific feature set in perpetuity (see Section 6).
- EU right of withdrawal: Under EU consumer law, you have the right to withdraw from a digital service contract within 14 days of purchase without giving any reason. However, by confirming your purchase and requesting immediate access to Heat Pass, you explicitly consent to the service starting immediately and acknowledge that your right of withdrawal is forfeited once the service has begun. Purchases are finalized through Apple or Google, who manage withdrawal requests in accordance with applicable law.
5. Third-Party Data Sources & Service Availability
HeatCheckr depends on data from third-party sources including, but not limited to, the NBA, EuroLeague, and other sports data providers. We do not own, control, or have any contractual relationship with these data providers.
- No availability guarantee: We do not guarantee uninterrupted, error-free, or continuous availability of the app or any of its features. The service is provided on a best-effort basis.
- Third-party API risk: If any third-party data source becomes unavailable, restricts access, changes its terms, discontinues its service, or is otherwise no longer accessible to us, features of HeatCheckr — including features included in Heat Pass — may be reduced, degraded, or permanently removed. This does not entitle you to a refund or compensation of any kind.
- Outages: Scheduled maintenance, unexpected technical failures, or disruptions caused by third parties may temporarily make the app or specific features unavailable. We will make reasonable efforts to restore service but cannot guarantee response time or recovery.
- Data accuracy: Game data, excitement scores, and labels are generated by automated systems. We do not warrant the accuracy, completeness, or timeliness of any information displayed in the app.
6. Feature Changes
We reserve the right to add, modify, suspend, or remove features at any time — including features included in the Heat Pass subscription — without prior notice and without liability. We will make reasonable efforts to communicate significant changes in advance where possible. Continued use of the app after changes constitutes acceptance of those changes.
7. Sports League Disclaimer
HeatCheckr is not affiliated with, endorsed by, or connected to the NBA, EuroLeague, or any other sports league, team, or governing body. All league-related names, trademarks, and content are the property of their respective owners. We use publicly available data for informational purposes only.
8. User Conduct
You agree not to reverse engineer, gain unauthorized access to, use for unlawful purposes, redistribute, or scrape data from our app or API. You may not share, sell, or transfer your Heat Pass subscription to any third party.
9. Intellectual Property
The HeatCheckr app, design, code, and original content (excluding third-party league data) is owned by JDK Development.
10. Disclaimer of Warranties
The app and all its features — including Heat Pass — are provided "as is" and "as available" without warranties of any kind, either express or implied. We expressly disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the app will meet your requirements, be available at any particular time, be secure, or be free of errors.
11. Limitation of Liability
To the maximum extent permitted by applicable law, JDK Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of access to features paid for via Heat Pass, or service interruptions — regardless of whether we were advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the app shall not exceed the amount you paid for Heat Pass in the 12 months preceding the claim.

Links to third-party sites (NBA.com, YouTube, etc.) are provided for convenience. We are not responsible for their content, availability, or privacy practices.
13. Governing Law
These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Germany, except where mandatory consumer protection laws in your country of residence provide otherwise. If you are an EU consumer, you may also be entitled to bring proceedings in the courts of your country of habitual residence.
14. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated via the app or this page. Continued use of the app after the effective date constitutes acceptance of the revised Terms.
